Observations and assessment

Preliminary independent scrutiny note, 22 October 2026. A miscellaneous-provisions Bill is not merely administrative where it changes existing enactments, institutional powers, offences, evidential rules or the continuity of ongoing legal proceedings. Every consequential amendment in Bill XXIII should be checked against the permanent NCA Bill, the Interim Bill and any replacement or repeal of the Financial Crimes Commission regime.

The priority is preventing uncertainty for investigations and cases already underway and ensuring that new powers do not enter the legal framework by an incidental amendment without scrutiny equivalent to the principal Bill. The observations here are preliminary because the individual statutory amendments have not yet been reconciled against the full official text.

Proposed amendments and rationale

Drafting and cross-reference safeguards for verification:

  1. Publish a clause-by-clause concordance showing every Act amended, provision repealed and replacement or transfer rule.
  2. Preserve validity and judicial control of lawful pending investigations, prosecutions, appeals, evidence, freezing orders and deadlines.
  3. Avoid any expansion of search, interception, detention or compulsory data-access powers through indirect statutory cross-references.
  4. Ensure that transferring records and databases preserves purpose limitation, security, privilege, audit trails and lawful deletion requirements.
  5. Specify precise commencement and transitional sequencing so no investigatory or remedial vacuum arises between regimes.

Final amendment language requires exact scrutiny of each schedule and cross-reference in Bill XXIII and the related Acts.

Text/version reviewed: Preliminary cross-legislation review; individual consequential provisions in official Bill XXIII still require verification.
