Observations and assessment

Preliminary independent scrutiny note, 22 October 2026. Temporary oversight arrangements must not turn into a period when serious decisions can be taken without independent accountability. The proposed Secretariat of the Independent Advisory (Interim) Panel should be assessed against the permanent Panel, the Interim Agency and the eventual handover to the permanent NCA.

The key question is whether the interim mechanism has a clear and limited mandate while maintaining a functioning channel for urgent concerns, integrity reports and protected disclosures. The assessment below identifies areas for legal scrutiny; it does not claim to reproduce or evaluate every provision of the current Bill.

Proposed amendments and rationale

Drafting directions for verification:

  1. State the precise interim purpose, legal powers, reporting line and commencement date.
  2. Specify independent appointment, conflict and removal protections appropriate to a temporary oversight structure.
  3. Maintain secure, accessible and documented avenues for urgent complaints or protected disclosures from the outset.
  4. Protect personal data and privileged information during processing and transfer.
  5. Link expiry and handover rules to the permanent Secretariat, retaining lawful case records, protective measures and ongoing review without gaps.

Final amendments should be reconciled with the permanent Panel and the Interim NCA Bills to prevent conflicting timelines or accountability gaps.

Text/version reviewed: Preliminary issues note; cross-Bill consistency between Bill XX, Bill XIX and Bill XVIII remains to be verified from the official text.
