MAURITIUS.NAME | INDEPENDENT LEGISLATIVE WORK

NCA Bills 2026: Proposed Amendments

A six-phase technical contribution intended to strengthen crime-fighting legislation while preserving constitutional legality, rights, judicial oversight and accountability.

27 September 2026Dave Kissoondoyal, LL.M. (Cyberlaw) | MBA (Information Systems)
Independent proposal, not an official Bill. This analysis and the six-phase amendment package were prepared from the two Bills circulated in September 2026. They do not constitute Government legislation, an enacted Act or Parliamentary Counsel text. The precise wording must be reconciled against the Bills subsequently listed on the Order Paper of 20 October 2026 (Nos. XVII and XVIII) and related Bills before any clause-by-clause comparison is described as current.

Two related Bills, two distinct analyses

Purpose and guiding approach

The amendment package does not propose abandoning the objective of investigating financial crime, cybercrime and serious organised crime. It proposes retaining sound provisions, amending those requiring clearer legal standards, and redrafting those that confer intrusive powers without sufficient controls.

Judicial authorisation

Search, seizure, interception and intrusive surveillance should be subject to robust legal thresholds and effective independent supervision.

Institutional independence

Director-General appointments and removal, the boundaries between investigative bodies and the role of the DPP require clear safeguards.

Privacy and data governance

The National Flagging Database, digital evidence, retention, access controls and data sharing require purpose limits, audit and remedies.

Transition and continuity

The move from the FCC and any Interim Agency must preserve pending investigations, proceedings, court orders, evidence, staff rights and lawful data handling.
