Observations and assessment

Preliminary independent scrutiny note, 22 October 2026. Effective prosecution of financial crime requires clear offences, reliable investigative powers, fair evidential rules and a prosecution system that preserves institutional independence. The Financial Crime Bill is part of the wider proposed NCA package and should be read alongside its investigative, asset-recovery and transitional Bills.

Legitimate crime-control objectives do not eliminate the need to define the conduct prohibited, the mental element, the persons liable and available defences with precision. Overlapping investigative and prosecutorial roles can also create uncertainty if responsibility, referral and oversight are not clearly allocated. These are scrutiny questions, not verified findings of defects in particular clauses.

Proposed amendments and rationale

Safeguards to assess against the official text:

  1. Define offences, culpability standards and associated penalties with legal certainty and proportionality.
  2. Preserve the Director of Public Prosecutions' constitutional prosecutorial independence and clarify case referral procedures.
  3. Protect the privilege against self-incrimination, legal professional privilege, fair-trial rights and judicially supervised compulsory powers.
  4. Require traceable digital and financial evidence, disclosure duties and meaningful avenues to challenge unlawful seizures or information orders.
  5. Reconcile offences, procedure and limitation provisions with the NCA, asset-recovery and consequential-amendments legislation.

These safeguards are proposed for scrutiny pending completion of a provision-by-provision analysis of Bill XXI.
